Further Use within Freie Universität Berlin
The items on offer here are intended for usage primarily within the university. The main goal is the prevention of waste by prolonging the life of an item. FUndgrube is not a platform for offering services or housing.
Continued Usage in Public or Charitable Organizations
If no buyer can be found within Freie Universität, other public institutions (such as schools) or charitable organizations may be contacted. The Unit for Sustainability and Energy Management makes this decision. When someone affiliated with the university cannot find a buyer for his items at the university, he or she may suggest a public or charitable organization that should receive the item in question.
Gratuitous Disposal of Low-Value Items and Goods
To avoid disposal and administrative costs, low-value items like binders or filing trays, can be passed on for free and without the requirement of continued usage at Freie Universität to university affiliates.
Selling to Freie Universität Affiliates (Employees and Students)
If public or charitable organizations express no interest, items can be given to university affiliates (employees or students) for their private usage for a minimum expense allowance or payment of the book value. The following rules apply to any kind of disposal:
- Freie Universität Berlin does not dispose of the item as a commercial business and, thus, under § 2 Abs. 3Nr. UStG does not include a sales tax. Should there nevertheless be tax liability according to the German Value-Added Tax Act, we will include a sales tax for the provided service later. The buyer waives the defense of the statute of limitations.
- As a buyer, Freie Universität Berlin acts as a public corporation and not as a business, when it disposes of assets it no longer needs for the fulfillment of its responsibilities of public administration. The Purchase of Consumer Goods regulations- (§§ 474 bis 479 BGB) do not apply.
- The buyer takes the object of purchase used and as seen caveat emptor. As a buyer, Freie Universität Berlin does not assume liability to ensure that the sold item can be used by the buyer for the intended purpose.
- A sales agreement is made for each sale. The sales price should be transferred within three days of signing the contract to the bank account of Freie Universität Berlin (Berliner Bank AG, IBAN: DE67100708480513128900, BIC: DEUTDEDB110) under specification of the reason for payment listed in the contract. If the buyer does not pay within this time frame, the seller may withdraw from the contract. The change of possession takes place only once the full purchase price has been paid.
