10. Facebook Fan Pages
Freie Universität Berlin maintains fan pages on the social media network Facebook as part of its public relations efforts. If you visit one of these fan pages, certain personal data will be processed. Facebook is run by Facebook Inc., 1601 Willow Road, Menlo Park, CA 94025, USA (“Facebook”). Facebook’s data processing in Europe is managed by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
Facebook provides extensive information about which personal data it processes and how it processes them. For example, Facebook uses information about you to create user profiles based on your interests by using cookies. Facebook’s data processing might occur outside of Europe. However, Facebook is “Privacy Shield” certified (https://www.privacyshield.gov/), which means it must adhere to the data protection standards of the EU.
The legal basis for processing personal data on the university’s fan pages is provided by Art. 6(1) point (f) GDPR in combination with Art. 3 of the Berlin Data Protection Act (BlnDSG) and Art. 4(6) of the Berlin Higher Education Act (BerlHG) insofar as the processing serves public relations work – or by Art. 6(1) point (f) GDPR insofar as the fan pages serve some purpose that goes beyond the scope of public relations. In such cases, the Freie Universität Berlin has a legitimate interest in processing data so that it can provide information and communication channels for interested parties.
Moreover, Freie Universität Berlin has concluded a joint controllership agreement with Facebook concerning shared responsibilities related to managing fan pages. You can object to the processing of your data at any time by sending an email to firstname.lastname@example.org. If you wish to assert your rights as a data subject, such as your right to information in the sense of Art. 15 GDPR, please contact Freie Universität Berlin or Facebook directly.
